Right to Buy is protected

Merton Priory Homes tenants can still buy their home. If tenants were entitled to buy their home with the council, they will still be able to buy it with Merton Priory Homes under what is called the Preserved Right to Buy.

Discount entitlement built up with the council transfers to the new organisation and continue to build to the maximum allowed, £16,000.

Other key rights and entitlements that are protected include:

  • the right to pass on your home (succession)
  • the right to transfer to another home and exchange homes
  • the right to sublet part of your home or take in lodgers
  • the right to repair
  • the right to carry out improvements and receive compensation
  • the right to be consulted
  • the right to information

These rights are protected and included in a new legally binding tenancy agreement that is more secure than the tenancy agreement tenants had with the council.

This new agreement can only be changed with an individual tenant’s written consent, unlike with the council, where the tenancy agreement could be changed after consultation only.
