Stage 1 - Making an application

Firstly you must fill in and return the application form ‘Notice claiming the right to buy’ which is known as the RTB1.

RTB1 application form - 'Notice claiming the right to buy' (485 KB)
Right to buy guidance notes (482 KB)

A paper version of the form is available from our offices, or by contacting us. More information is available on DirectGov's website.

The government also has advisory booklets available:

  • Your right to buy your home
  • Thinking of buying a Council flat?
  • Long leaseholders, your Rights and Responsibilities

These booklets are available at our office by contacting us or from the Communities and Local Government website.
When we have received and checked your application form we will acknowledge your application and establish if you are eligible to buy your home. Some properties are exempt from the Right to Buy e.g. properties in sheltered housing schemes, and some properties designated as being particularly suitable to house a person aged 60 or over. Also some individual tenants are not eligible for the Right to Buy e.g. undischarged bankrupts, and tenants subject to a court order for possession.

An RTB2 Notice will be sent to you to tell you if we can accept your application to buy or not. The RTB2 Notice will be sent within four weeks if you have been a tenant with Mole Valley Housing Association for two years or more. If you have not been a tenant with Mole Valley Housing Association for two years it will take up to eight weeks to reply to you because we have to check the information on your other tenancies with your previous landlord.

If we cannot accept your application, we will give you the reason why on the RTB2 Notice.

You should keep the RTB2 Notice in a safe place as you may need to give it to your bank or building society if you are having a mortgage.

As soon as your Right to Buy application is received any improvements or repairs that are due to be done will be cancelled (except for work required by law to keep the property weather-tight). This is because when the property is valued the valuation is based on the date your RTB application was made. Any improvements or repairs after that date would affect the valuation.
